Terms & Conditions

These Terms & Conditions ("Terms") govern your use of Orbitry (the "Service"), operated by Next Nutrition LLC ("we", "us", "our"). By accessing or continuing to use the Service, you agree to be bound by these Terms.

1. Definitions

"Service" means the Orbitry website, Progressive Web App (PWA), and all features, content, and tools provided through them.

"User Content" means any content you create, submit, store, upload, broadcast, provide, or share using the Service, including journal entries, voice notes, photo attachments, Life Events, My Saved Documents files, Astreus transcripts, Pulse check-ins, Companion reports, community posts, replies, direct messages, sightings, reviews, and profile gallery photos.

"Public User Content" means User Content that the Service displays to people other than you, either because the feature is inherently shared or because you chose to share it: community posts and replies, thread and chat messages, tags, reactions, mentions and their attachments, Sightings photos and captions, room playlists you contribute to, reviews, your display name and chart badge, profile-gallery photos while gallery visibility is on, On Repeat pins while their visibility is on, and anything you publish through a share link.

"Private User Content" means all other User Content — journal entries and their voice notes and photo attachments, Quick Journal and Companion journals, Life Events, My Saved Documents files, Pulse check-ins, Compass and seasonal reports, Ask Astreus and Live Chat transcripts, Reach Out responses and comparisons, Companion records, notes and reports, Community Bookmarks, hidden posts, and votes. Private User Content is visible only to you, except where these Terms or the Privacy Notice say otherwise (for example, a reported direct message reviewed by a moderator, or a safety flag reviewed under Section 17 of the Privacy Notice). Direct messages are private between the participants in the thread.

"Astreus" means the AI-powered star guide within the Service.

"Community" means the social features of the Service, including sign-based rooms, posts, threads, chat, direct messages, and related features.

"Subscription" means a recurring payment plan that grants you access to premium features of the Service.

"Company," "we," "us," and "our" means Next Nutrition LLC.

"You" and "your" means the person entering into these Terms with Company.

2. Eligibility & Authority

You must be at least 18 years of age to create an account or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind it.

U.S. residents only. The Service is offered exclusively to residents of the United States. By creating an account, you represent that you are a U.S. resident and located in the United States. We may verify eligibility using the IP address of your sign-up request, and we may refuse or terminate service to anyone we determine is outside the United States.

3. The Service

Orbitry is an entertainment and self-reflection product — a visual reflective journaling tool with an astrological substrate. It does not provide psychic, medical, mental health, financial, legal, or psychological advice, and does not purport to predict the future. Where a report names a specific date, it describes what the sky is doing and what that placement is traditionally said to suggest; it does not state, forecast, or promise that any particular event will happen to you on that date or at all. Astrological elements are provided for Service aesthetic and entertainment theme.

The Service currently includes: a personalized interactive Mirror Path Galaxy and a Zodiac Galaxy view with transits, aspects, and Pathfinder; overview windows for your Aspects, Houses, Big Three, and Slow Clock; a Daily Cards stack featuring Today's Pulse (with the Big Three Spotlight on its back face), Star File, Sun Sign, Moon Moment, special sky-event cards, Week Ahead, Mirror Path Spotlight, Aspect of the Day, Astreus x Music, Heart Mirror, Famous Figure Echo, Mirror Path Spotlight (including Pathfinder), Journal History, Surveys, and Zodiac Season, each with a short in-card explainer, and with optional share links and PDF downloads for some cards and reports; a 3-card past/present/future Compass reflection synthesized from reports, journals, vibe check-ins, and music, and Seasonal Reports (Week, Month, Season, Year); journaling with voice notes and photo attachments, plus Quick Journal and Companion journals, with free and Premium allowances as shown on the pricing page; a Life Events calendar for building a timeline; per-feature history (Journal, Ask Astreus, My Saved Documents, Song of the Day); an AI star guide called Astreus, including Astreus Read Aloud narration, Astreus Live Chat, and 8 selectable, user-renameable voices; Resonance modes (Chart-to-chart, Mirror Me, Famous Figures, Astreus x Music); Badges; Reach Out, which invites someone you choose to answer your onboarding questions, in their view; Companion reports and analytics; a Guidebook; and an optional Community layer with sign-based rooms, posts, Threads and Chat with tags, replies, reactions, mentions, file and image attachments, direct messages, follows, Community Bookmarks, a Prompt of the Week (with prior prompts kept behind it), Sightings threads for sky photos, a profile photo gallery, room playlists, and sign overviews. Features may be added, changed, or removed over time.

4. Account & Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You represent that you have the rights to submit any User Content you upload, including any birth chart, image, or file you add to My Saved Documents. You are solely responsible for your User Content and for choosing whether to enable cross-device sync (see our Privacy Notice) for your private reflective content.

Inactive accounts. We may terminate an account that has been inactive for twelve (12) consecutive months, and delete its content, after giving you notice. We email the address on your account after six (6) months of inactivity, and again after ten (10) months — that second notice states that if two (2) more months pass without activity, we reserve the right to terminate the account and delete its content. Signing in, or any other use of the Service, resets the inactivity clock. Termination for inactivity is treated as termination by us under Section 12.

5. Acceptable Use

You must not use the Service inconsistent with these Terms & Conditions here. By using the Service, you agree not to:

• use the Service for any unlawful purpose, fraud, or spam;
• infringe intellectual property or privacy rights of others;
• introduce malware or attempt to probe, scan, or compromise the Service;
• scrape, harvest, or reverse engineer the Service or its content;
• resell, redistribute, or circumvent technical limitations of the Service;
• attempt to extract system prompts or underlying instructions from Astreus, resell or transfer Live Chat minutes or account access, or automate or script Astreus Live Chat sessions;
• use alternate accounts to evade a block, hide, or ban or other moderation action;
• harass, threaten, dox, or impersonate other users, staff, or third parties;
• send unsolicited sexual, or commercial messages;
• use community features (posts, replies, DMs, mentions, reactions, follows, or the Resonance signal) to target, shame, or coordinate unlawful or unethical action against another person;
• upload content that incites violence, or promotes self-harm, or poses any harm to minors;
• publish, share, or send intimate or sexually explicit images or video of an identifiable person without that person's consent, including images of yourself and another person, and including in direct messages, Sightings threads, profile galleries, and attachments;
• create or share a digital forgery — an AI-generated or digitally altered depiction of an identifiable person, whether intimate, defamatory, or presented as something that person said or did;
• use the Service to generate, distribute, or train AI models on other users' content, or to pass off AI-generated content as another person's reflection.

Intimate imagery: notice and removal. If an intimate image or digital forgery of you has been shared on Orbitry without your consent, report it in the app (Left menu, "Report an Issue") or write to our contact form with enough detail to locate the content and a statement that you did not consent to its publication. We will remove the content, and any known copies of it, within 48 hours of receiving a valid request, and we may restrict or terminate the account that posted it. You do not need an account to send such a request.

6. Intellectual Property

The Service, including its software, design, branding, written content, and underlying technology, is owned by Next Nutrition LLC and is protected by intellectual property laws. All rights not expressly granted to you are reserved by Next Nutrition LLC.

We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your chosen plan. You may not copy, modify, reverse engineer, decompile, or create derivative works of the Service.

You retain ownership of all content, data, and information you submit to the Service. You grant us a limited license to host, process, and display that content to provide the Service to you.

7. User Content

You retain ownership of journal entries (including voice notes and photo attachments), Quick Journal entries, Companion journals, Life Events, My Saved Documents files, Astreus voice session transcripts, daily Pulse check-ins, Companion records and notes, sighting photos, profile-gallery photos, Community Bookmarks, tags, content up or down votes, community posts, replies, direct messages and their attachments, reviews, and other content you create ("User Content"). Content up or down votes are private and are not shown to other users.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, process, and use your User Content to operate, improve, and promote the Service. This license includes the right to create anonymized, aggregated data for research, analytics, and product development purposes. For Public User Content, this license extends to showing that content to other signed-in users in accordance with the visibility you selected. This license continues for as long as your User Content is protected by intellectual property laws.

Share links. When you create a share link for a card, that link renders a public page and preview image containing the shared content. Anyone with the link can view it, including people without an account, and you are responsible for deciding what you share and with whom.

Downloads and attribution. Companion reports and other Reports may be downloaded as PDFs for your own use. Astreus prose remains subject to section 6: you may keep, print, and share it personally, but you may not republish it commercially or present it as your own product. When you copy a longer passage, the app appends a short Orbitry attribution line; you can turn that off in Privacy Settings, which does not change the license above.

Sightings. A photo you post to a Sightings thread is shared with other signed-in users. Post only photos you took or otherwise have the right to share, and do not post images of identifiable people without their consent.

Companions. Companions involve information about another person. You represent that you are entitled to enter and use any birth details, photo, or notes you add about a Companion, and that you will not use Companion features to profile, monitor, or make decisions about that person. Companion reports are reflective content subject to section 7b and are visible only to you.

Reach Out. Reach Out works by sending a private link to a person you choose, who then answers the same user survey questions about how they experience you. Only send a Reach Out link to someone who has agreed to take part. Once a Reach Out recipient completes the user survey, a comparison is generated by AI for the User, and is subject to the AI limitations described in section 7b.

7a. Community, Direct Messages & Moderation

The Community layer, including sign-based rooms, direct messages, file and image attachments, mentions, reactions, follows, room playlists, sign overviews, Sightings threads, and the Resonance signal, is subject to our Community Guidelines (also found in the Community feature, see the "Guidelines" button). By using those features you agree to follow the guidelines. We may, in our discretion, hide, remove, restrict, or delete User Content, disable community features for an account, or suspend or terminate accounts that violate the guidelines or these Terms.

Direct messages are visible to the participants in the thread and to moderators when a message is reported. The chart to chart user Resonance is opt-in and can be turned off from your profile settings. Blocks, mutes, hides, and reports are provided as safety tools; we do not guarantee that any moderation action will meet any particular timeline or outcome.

Appeals. If we remove your content, disable community features, or suspend or terminate your account, you may appeal by writing to our contact form within 30 days, providing the action taken and why you believe it should be reversed. We aim to respond within 30 days. Appeals about non-consensual intimate imagery or content involving minors remains removed until review and a final decision is made and all appeals, or the timeline for the same, exhausted.

7b. AI Features

Astreus and other AI-powered reflections — including Ask Astreus, Astreus Read Aloud, Astreus Live Chat, Compass and its seasonal reports, the Aspects, Houses, Big Three and Slow Clock overviews, entry titles, planet-in-sign reflections, Mirror Me, Reach Out comparisons, Song of the Day picks and reasons, Companion reports, and Companion prompts — are provided for personal reflection and entertainment purposes. AI output can be inaccurate, incomplete, or unexpected, and does not constitute medical, mental-health, financial, legal, or psychological advice. Spoken replies in Astreus Read Aloud and Astreus Live Chat are generated by AI and can likewise be inaccurate. Voice sessions are recorded as transcripts that you can retrieve from your account. You are solely responsible for how you may receive or react to or on any AI output. We do not use AI output to make automated decisions about your account, billing, or access.

Astreus is not a substitute for professional advice. You should not rely on Astreus or any AI-generated content for decisions regarding your personal, professional, medical, legal, or financial matters. Always consult a qualified professional for advice in those areas.

How AI inputs are processed. Reflections are generated by our AI provider (Google/Gemini), or another provider where Gemini may be unavailable, routed through a paid API gateway. The spoken side of Astreus Read Aloud and Astreus Live Chat is processed by our voice provider (ElevenLabs). Both Gemini and ElevenLabs act as our processors under written terms, and your content is never used to train their models, sold, rented, or shared with advertisers or data brokers. Section 9 (AI Features) and Section 11 (How We Share Your Data) of our Privacy Notice describe this in full.

Not for emergencies. The Service is not designed or intended for emergencies: crisis resources may be shown to you in certain conversations, and an internal safety-flag record may be created and reviewed as described in Section 17 (Crisis-Support Safety Flags) of our Privacy Notice, but the Service is not a crisis service, is not monitored in real time, and does not provide medical or mental-health care.

7c. Music & Third-Party References

Song of the Day, sign-room playlists, and other Astreus x Music surfaces reference publicly known artists, songs, and albums for editorial and reflective purposes. Orbitry does not host, stream, or distribute audio recordings, and references to artists or works do not imply endorsement, sponsorship, or affiliation. Trademarks and names remain the property of their respective owners.

Famous Figure Echo, Mirror Me, and other Famous Figures surfaces reference publicly known people, and publicly reported or widely circulated birth information about them, for editorial and reflective purposes. Birth data for public figures is often uncertain or disputed, and we make no representation that it is accurate. No named figure endorses, sponsors, or is affiliated with Orbitry, and nothing shown about a figure is a statement of fact about that person's character, conduct, or private life. Names, likenesses, and trademarks remain the property of their respective owners.

8. Payments, Subscriptions & Cancellations

Payments are processed by our payment provider, Stripe. Payment, billing, taxes, and cancellations are governed by Stripe's Services Agreement.

Subscriptions renew automatically at the end of each billing period until canceled. You may cancel at any time through the in-app billing portal. Cancellation stops future renewals; your Premium access continues until the end of the period you have already paid for.

Refunds. Payments are non-refundable, including for partial billing periods and unused allowances, except where a refund is required by applicable law. Nothing here limits any refund or cancellation right you have under the law of your state.

Pricing changes. The price of a subscription is the rate shown on the pricing page at the time you subscribe. If we change the price of an existing subscription, we will notify you by email and on the sign-in screen at least thirty (30) days before it takes effect, and you may cancel instead of accepting it.

8a. Live Chat Minutes

Astreus Live Chat is metered in minutes. Each account receives a one-time, non-renewing free trial of Live Chat minutes, as shown on the pricing page; Premium includes a monthly allowance of Live Chat minutes. There is no cap on the length of an individual call. Unused included minutes roll over for one additional month, and your included balance is capped at 60 minutes; anything above that cap at the start of a billing period is not carried further. Beyond the included minutes, additional time may be purchased as flat-rate packs processed through Stripe. Included minutes are spent before purchased minutes, and purchased pack minutes remain available until used. Unused balances are non-transferable and cannot be shared, gifted, resold, or moved between accounts. Any time estimates shown to you during a call are approximate; your minute ledger — the remaining balance shown on the Astreus card and in the left menu under Astreus Live Chat — governs your remaining time, not the in-call estimate.

9. Service Availability

We strive to keep the Service available, but we do not guarantee uninterrupted or error-free performance. Maintenance, updates, or events beyond our control may cause temporary unavailability.

Progressive Web App. The Service is delivered as a Progressive Web App (PWA) accessible through your web browser. Because the Service is not distributed through the Apple App Store or Google Play Store, standard app store terms and policies do not apply. The PWA is licensed, not sold, to you. Your use of the PWA is governed solely by these Terms and our Privacy Notice.

10. Warranties & Liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. Our aggregate liability for any claim relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

11. Indemnity

You agree to indemnify Next Nutrition LLC against claims arising from your user content, your unlawful use of the Service, or your breach of these Terms.

12. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms or any Service guidelines, non-payment, suspected fraud or security risk, or prolonged inactivity as described in Section 4. Upon termination, your right to use the Service ends.

Your data on termination. You can export your data at any time while your account is open (Account and Privacy). What happens to your data depends on who ends the account:

If you delete your account yourself

Deletion begins immediately and is irreversible. There is no reactivation window and no grace period, and we cannot restore the account or its content for you, as described in Section 12 (Data Retention) of our Privacy Notice. Export anything you want to keep before you confirm deletion. Because the account and its content are already gone, there is nothing left for us to send you afterward, so a later access or deletion request has nothing to act on.

If we suspend or terminate your account

We do not delete your content at the moment we terminate. You may still ask us for a copy of your data, or ask us to delete it, by filing a privacy request under Section 14 (Your Rights) of our Privacy Notice. If you make no request, we delete the account and its content in the ordinary course under the retention schedule in Section 12 (Data Retention) of the Privacy Notice.

In both cases, some records are retained where law requires, and published community content may remain in anonymized form to preserve conversation context.

13. Governing Law & Dispute Resolution

13.1 Governing Law. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

13.2 Mandatory Individual Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively by binding individual arbitration administered by the National Arbitration and Mediation ("NAM") under its then-current rules. The arbitration shall be conducted in Fulton County, Georgia. You and we agree that any arbitration shall be conducted on an individual basis only and not as a class, collective, consolidated, or representative action. The arbitrator, and not any court, shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration provision.

13.3 Opt-Out. You may opt out of this arbitration provision within thirty (30) days of the date you first create an account by sending a written notice to Next Nutrition LLC at our contact form, stating your intent to opt out. If you timely opt out, you and we agree to the exclusive jurisdiction and venue of the Superior Court of Fulton County, Georgia (Business Court Division) for claims arising under state law, and the United States District Court for the Northern District of Georgia for claims arising under federal law, and each party consents to personal jurisdiction in those courts.

13.4 Small Claims. Either party may bring a claim in small claims court, provided the claim is within that court's jurisdiction and is brought on an individual basis.

13.5 Jury Trial Waiver. To the fullest extent permitted by law, both parties waive the right to a trial by jury in any action or proceeding arising out of or relating to these Terms or the Service.

14. Assignment & Force Majeure

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for failure to perform due to events beyond reasonable control.

15. Changes

We may update these Terms from time to time. The "Last updated" date above will reflect the most recent change.

For a material change, we email the address on your account, naming what changed in plain language, when it takes effect, and a link to read the updated Terms. The same notice appears on the sign-in screen. Continued use of the Service on or after the effective date constitutes your acceptance of the revised Terms. Minor edits — typo fixes, clearer wording, a renamed feature — update the "Last updated" date without a separate notice.
